What is a utility bill?

A utility bill is a detailed invoice from a service provider for your consumption of utilities such as electricity, internet, water. Some companies send you the utility bills monthly or every 2 months, especially for us in Trinidad and Tobago for electricity.

Why are utility bills important for entrepreneurs?

As a business owner, you will be asked to present a utility bill as your proof of address in order to conduct the following transactions:

1.Open a Business Bank Account (as well as personal bank account);

2.Get a Business Loan;

3.Get a credit card;

4.Purchasing a car

5.To get a mortgage to buy land

What is Proof of address?

This is verification of your residential address. Financial institutions and listed businesses in Trinidad must obtain a utility bill from all customers. This is stated in law , particularly at Regulation Proof of Address 15 (1) (b) “permanent address and proof thereof” Financial Obligations Regulations. There is a body of laws and regulations that aims to fight anti-money laundering and the countering the financing of terrorism.

What happens if utility bill is not in your name?

Authorization Letters

If the bill is not in your name, you must present a letter of authorization from the person whose name appears on the bill as well as a copy of the persons National ID card. The signature on the letter must match the signature on the person’s ID card.

Parents/Family

Usually the utility bill is in the name of a parent and you can get a letter of authorization from your parent.

Tenants

There are other cases where, you are renting, and your landlord has to provide you with the authorization letter and copy of ID.

Deceased Persons

In the event that the person whose name is on the utility bill is deceased, this bill will not be accepted by financial institutions. You will be asked to return to the Service Provider and follow their internal process to get the name changed.

Best Practice?

It would be wise to get a utility bill in your name; it can be as easy as taking out the internet in your name in the instance of persons living with their friends.

Sample Table of Contents (AML/CFT/PF) Compliance Program: AML Compliance Consultants

There are five crucial elements of an Anti-Money Laundering/Countering the Financing of Terrorism and Proliferation Financing AML/CFT/PF Compliance Program. These are ;

Risk Assessment;

Appointment of a Compliance Officer;

Internal Compliance Controls;

Training of employees and Senior Management;

Independent Audit.

Policy Statement

It must be explicitly stated that all employees must comply with the AML/CFT/PF policies and procedures. It may also be stated that the entity is committed to complying with the laws and regulations to combat money laundering, financing of terrorism and proliferation financing. 

An Overview of Money Laundering and Terrorist Financing

Define money laundering, terrorist financing and proliferation financing. Explain that there are certain reports that must be filed by certain businesses to file certain reports.

Internal Controls, Policies and Procedures

Detail the Customer Due Diligence and Know Your Customer Procedures.

 Explain the Enhanced Due Diligence Measures (EDD) to be applied to high risk customers.

State the procedures to govern all payment methods. What are the due diligence requirements for large transactions of TT$50,000 and over and wire transfers of $6000.

State whether there is an internal threshold in order for a Source of Funds Declaration (SOFD) to be completed.

Employee Training

It should be stated that the AML/CFT/PF training should be conducted at least one a year. The Compliance Officer and Alternate Compliance Officer need more intensive training.

Review of the Compliance Programme

The Compliance Program should be reviewed at least once a year. The Compliance Program must be updated to reflect amendments in the law.

What is the United Nations (UN) 2253 List ?: AML Compliance Consultants

Initially, this terrorist list contained a listing of the Taliban states that were subject to a limited air embargo and frozen assets.

Over time, the regime evolved and the measures became a targeted assets freeze, travel ban and arms embargo against designated individuals and entities

On 17 December 2015, the United Nations Security Council unanimously adopted resolution 2253 (2015). With the adoption of this resolution, the Security Council decided to expand the listing criteria to include individuals and entities supporting the Islamic State in Iraq and the Levant (ISIL)[1].

As you know, car dealers are considered “listed businesses” under Anti-Money Laundering laws and regulations in Trinidad and Tobago. This post should be helpful if you want to create a checklist for your Car Sales files.

 Bank Financing Approval (where applicable)

Receipt(s)

Insurance Cover Note

For registered Limited Liability Companies in addition to the above):

Certificate of Incorporation or Certificate of Continuance;

Articles of Incorporation;

Identification documents for all directors and authorized account signatories;

Most recent Annual Returns;

Management Accounts or;

Cash Flow projections for at least 3 years (for companies registered less than 3 years)

Signed Director’s statement outlining the nature of the company’s business;

Evidence of authority to enter into the business relationship e.g. copy of the Board Resolution giving authorization to signatories;

Power of Attorney or other authority where applicable;

Company Bye Laws where applicable

For Individuals:

Two valid forms of unexpired government issued identification;

Job letter and payslip;

How to Report Proliferation Financing Funds in your possession (ESR): AML Compliance Consultants

The purpose of the Economic Sanctions (Implementation of United Nations Resolution on the Democratic Republic of Korea) Order, 2018 and the Economic Sanctions (Implementation of United Nations Resolution on the Islamic Republic of Iran) Order, 2018 is to implement measures to prevent and disrupt the financing of the proliferation of weapons of mass destruction which constitutes a substantial threat to both domestic and international peace and security.

The Economic Sanctions (Implementation of United Nations Resolution on the Democratic Republic of Korea) Order 2018  and the Economic Sanctions (Implementation of United Nations Resolution on the Democratic Republic of Iran) Order 2018 seeks to put measures in place to prevent the proliferation of weapons of mass destruction (WMD) . The Proliferation of weapons of mass destruction poses a clear and present danger to global peace and security.

Listed Businesses (LBs) and Financial Institutions (FIs) must consult the list of entities which have been subject of a freezing Order by the Supreme Court in Trinidad and Tobago and inform the Financial Intelligence Uni (FIU) where the FI or LB knows or has reasonably suspects that an entity named in the Court Order has property or funds in the FI or LB; or

A transaction is being conducted by an individual involving property or money owned or controlled by an entity named in the Court Order.The prescribed form is the Economic Sanctions Reporting Form.

Occupation/Nature of Business-For self employed persons, sole traders. Submit proof eg job letter, payslip.;

Occupational Income-Submit proof eg job letter, payslip.

If self employed-Please state what services or products are offered and provide proof;

Are you a Non Resident ?-Please provide foreign bank reference letter.

Beneficial Owner Information

The Name of the Beneficial Owner-The natural person(s) who ultimately owns or controls a customer and/or the natural person on whose behalf a transaction is being conducted. It also includes those persons who exercise ultimate effective control over a legal person or arrangement.” FATF

Politically Exposed Person (PEP)

Source of Wealth Declaration (only applies to PEPs and High risk Customers) .

Source of Wealth– refers to the origin of the customer’s entire body of wealth, ie their total assets- since they are PEPs , they are more susceptible to bribes and corruption

Source of Funds Declaration ( applies to all customers)

Source of funds refers to the activity that generated the funds and the location thereof to be used to finance the transaction eg salary payments in savings account at ACB.

Can I upgrade my Sole Trader to a Limited Liability Company in Trinidad and Tobago?

My new client told me that he already has a Sole Trader business and he now wants to change it to a Limited Liability Company. He told me that the business was performing well and was desirous of purchasing land. He wanted to buy the land in the name of his business. The bank informed them that the land can only be purchased in the name of a Limited Liability Company not a Sole Trader Business. The reason is that a limited liability company is a separate legal entity. A sole trader is not a separate legal entity recognized by law.

Who must file Terrorist Funds Reports (TFRs) in Trinidad?(Free AML Training)

Both Financial Institutions (FIs) and Listed Businesses (LBs) are required to file TFRs in Trinidad and Tobago.

FIs and LBs must consult the United Nations 2253 List and the Trinidad and Tobago Consolidated List of High Court Orders. If the FI or LB knows or has reasonable grounds to believe that a designated entity has property or funds in Trinidad and Tobago. The FI or LB will then contact the FIU and indicate that the LB/FI has property or funds belonging to a designated individual or entity. The Terrorist Funds Report is then completed and submitted soft copy via the FIU’s secure reporting system or by hand via a sealed envelope.
